Helping Military Members and their Spouses Through a Divorce

The Maryland child custody and visitation lawyers have handled hundreds of cases involving child visitation disputes.  Visitation may be sought in Maryland Courts by parents, grandparents and even a non-adoptive stepparent.

The factors considered by the Court in child custody determinations are similar to the factors considered by the Court in determining visitation. The child custody lawyers at RGPH can help identify the critical factors for or against child visitation and the evidence necessary to establish those factors.

The most important factor is what level and type of visitation is in the best interest of the child. The best interest standard is discussed in detail under the child custody section. A child's routine and schedule is important and should not be significantly disrupted by a visitation order. Maryland Courts also prefer regular visitation schedules because children are better served by structure.

In most cases a Court may not condition visitation on the payment of financial obligations under a divorce decree or support order.  A parent may not be totally denied visitation for failing to fulfill financial support obligations.  Even in a case where sexual abuse had been committed by a noncustodial parent in the past, visitation was not totally denied.  In such cases visitation is likely to be structured, restricted and/or supervised.

An area of dispute among divorced parents is whether a noncustodial parent should be able to visit the child in the presence of that parent's paramour.  Maryland Courts have restricted the rights of a parent to visitation with a minor child in the presence of the paramour.  Such restrictions are only issued if evidence is shown that the visitation would be detrimental to the child and/or not in the best interest of the child.
